Architectural Review Board
As of August 14, 2024, the Board supplemented the Bylaw provisions for architectural control with the following resolution setting forth ARB organizations and procedures. Below you can find a link to the Submission Form as well as excerpts from the Bylaws themselves.
1. Before or during each year’s annual meeting, the Board will solicit nominations (including self-nominations) for appointment to the ARB.
2. At its first quarterly meeting after the annual meeting, the Board will appoint the ARB members. The Board may appoint persons not otherwise nominated, but will take the nominations into consideration when making its appointments.
3. The Board will designate one of the ARB members as Chair of the ARB.
4. All Co-owner requests for approval shall be set forth on a form to be determined by the Board and to be made available via the Association’s website. The form shall be accompanied by plans and specifications prepared by a licensed architect or other persons satisfactory to the ARB, and shall be prepared in form as determined from time to time by the ARB. The form and plans together constitute the “Submission.”
5. Co-owners shall file Submissions in writing with the President of the Association who shall promptly forward them to the Chair of the ARB. The date of such forwarding shall constitute the Submission Date.
6. The Submission may include preliminary or design development plans, but the ARB may, in its reasonable discretion, require in writing from the Co-owner before final approval or disapproval as part of the Submission those materials set forth in Article VI(A), Section 3 of the Bylaws.
7. The Chair of the ARB shall be responsible for polling the members of the ARB and reporting the vote to the President. A vote of two or more members of the ARB shall be sufficient for approval. The Chair shall promptly communicate any approval or disapproval to the President in writing, who shall in turn communicate it in writing to the Co-owner.
8. A Co-owner shall have a right of appeal of any disapproval to the Board of Directors, whose decision on such appeal shall be final.
9. In the event the ARB fails to approve or disapprove a Submission within thirty (30) days after the Submission Date, or ten (10) days after its receipt of materials set forth in Paragraph 6 above, whichever is later, then such approval will not be required, but all other limitations, conditions and restrictions set forth in these Bylaws shall apply and remain in force as to such plans.
10. The Association shall retain the complete Submission in its books and records.

Article VI A, Section 1 of the Association Bylaws provides:
“The purpose of this section is to assure for the benefit of the Co-Owners … and the Association, that the improvements hereafter erected within the Condominium will be harmonious with one another and with the area in which the Condominium is located. To assure such harmony and compatibility, the Association shall establish an architectural review board (“Review Board”) which shall consist of three (3) members, all of whom … shall be appointed by the Board of Directors of the Association, for an unlimited number of one (1) year terms. Such Review Board shall have the right to approve or reject plan for any Improvements (as defined below) to be constructed with the Condominium Project and any modifications or alterations thereto.”
